1. About these terms
These Terms of Service ("Terms") govern your use of the CallOut platform, operated by Vbird Ltd, a company registered in England and Wales, trading as CallOut ("we", "us", "our").
By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the service. These Terms form a legally binding contract between you and Vbird Ltd.
2. The service
CallOut provides AI-powered tools for UK tradespeople, including: missed-call SMS recovery, AI-managed customer conversations, automated quote and invoice generation, a booking calendar, and related business management features ("the Service").
The Service uses artificial intelligence to communicate with your customers on your behalf. You are responsible for the business in whose name the AI operates. You must review the AI's conversations and correct any errors. We do not guarantee the AI will qualify every lead correctly or convert every enquiry into a job.
3. Free trial
New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial period, you will be prompted to subscribe. If you do not subscribe, access to paid features will be suspended.
4. Subscriptions and payment
After the free trial, CallOut is available on monthly subscription plans. Prices are displayed on the upgrade page and are inclusive of VAT where applicable. Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis.
- Subscriptions renew automatically each month unless cancelled before the renewal date.
- You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.
- We reserve the right to change subscription prices with at least 30 days' notice to existing subscribers.
- If a payment fails, we will attempt to retry and notify you by email. Continued non-payment may result in suspension of your account.
5. Money-back guarantee
We offer a 30-day money-back guarantee on your first paid month, subject to the following conditions:
- You must have set up call forwarding on your mobile and actively used the Service during the 30 days.
- You must contact us within 30 days of your first payment to request a refund, stating that you did not recover at least one job via the Service.
- Refund requests must be sent to hello@calloutnow.co.uk.
- We will process eligible refunds within 10 business days to your original payment method.
- This guarantee applies once per customer. It does not apply to renewals after the first month.
This guarantee does not affect your statutory rights under UK consumer law.
6. Your responsibilities
- You must be a business owner or sole trader using the Service for legitimate commercial purposes.
- You are responsible for ensuring your customers are aware their messages may be handled by an AI assistant on your behalf.
- You must not use the Service to engage in any unlawful activity, including sending unsolicited messages, misrepresenting your business, or collecting data you are not entitled to collect.
- You must not attempt to reverse-engineer, circumvent, or misuse the AI system.
- You are responsible for the accuracy of your business profile information, including any Gas Safe registration number you provide.
- You must keep your login credentials secure and notify us immediately of any suspected unauthorised access to your account.
7. AI limitations and your oversight duty
The CallOut AI assistant is designed to qualify jobs and capture customer details. It operates under strict guardrails including:
- It will never quote a price on your behalf.
- It will always direct gas emergency enquiries to 0800 111 999 immediately.
- It will always identify itself as an AI if directly asked.
Despite these guardrails, AI systems can make mistakes. You are responsible for monitoring your conversations and correcting any errors before acting on them. Vbird Ltd accepts no liability for losses arising from the AI's responses, missed leads, or incorrect information provided to customers.
8. Data ownership and licensing
Your data: You retain ownership of your business data, customer data, and conversation content generated through the Service. You grant Vbird Ltd a non-exclusive, worldwide, royalty-free licence to store, process, and use that data solely for the purposes of providing and improving the Service, as further described in our Privacy Policy.
Anonymised data: Vbird Ltd may anonymise, aggregate, and use data derived from platform usage — including conversation patterns and job enquiry structures — for AI model training, evaluation, and commercial data licensing purposes. Such anonymised data will not contain information that directly identifies you or your individual customers. Full details are in Section 4 of our Privacy Policy.
Vbird Ltd's intellectual property: The CallOut platform, its underlying software, AI models, and all related intellectual property remain the exclusive property of Vbird Ltd. You may not copy, reproduce, or distribute any part of the platform.
9. Availability and changes to the service
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, update features, or temporarily suspend the Service without notice in the case of urgent issues. We reserve the right to modify, add, or remove features at any time. Material reductions in functionality will be communicated with reasonable notice.
10. Limitation of liability
To the maximum extent permitted by law:
- Vbird Ltd's total liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the total subscription fees you paid in the 12 months preceding the claim.
- We are not liable for any indirect, consequential, or special losses, including loss of profit, loss of business, or loss of data.
- We are not liable for losses caused by third-party services (including telephony networks, AI providers, or payment processors), call forwarding failures, or network outages outside our control.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
11. Termination
You may terminate your account at any time by cancelling your subscription and deleting your account from your settings. We may terminate or suspend your account immediately if you breach these Terms, engage in fraudulent activity, or if required to do so by law.
Upon termination, your access to the Service will cease. We will retain your data for the period described in our Privacy Policy and then delete it.
12. Governing law
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be notified to registered users by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
